Of food waste, food chain and circular economy. A comparative study of the ethico-environmental implications of food waste and its implementation in the Spanish legal system
    (2026-10-06)
The present analysis addresses the structural contradiction of contemporary societies: the persistence of food waste in a context of overproduction and chronic hunger. A rigorous exercise in comparative law is undertaken to examine how the right to food is intertwined with environmental protection, taking ‘ecological constitutionalism’ and the jurisprudence of international courts as a reference. The study proposes a transition towards models of bioeconomy and circular economy, where surpluses are reconfigured as strategic resources instead of waste. To this end, the application of key ecological principles to the entire food chain is evaluated, internalising the environmental costs of inefficiency under the logic of ‘the polluter pays’. Within this framework, Law 1/2025 is examined as the major milestone of the Spanish legal system, highlighting its capacity to elevate this problem to the rank of positive law and establish binding obligations. The analysis culminates in the defence of a hierarchy of priorities that prioritises social justice and redistribution for human consumption over any other form of management. Ultimately, the work demonstrates that combating waste requires transforming ethical responsibility into legal mandates that guarantee intergenerational sustainability.

The present study examines the complex ethical and legal challenges associated with including mental disorders as qualifying conditions for euthanasia in Spain. The ruling of the Constitutional Court 19/2023, dated March 22, explicitly excludes mental disorders from the circumstances that permit access to this provision, restricting the right to die solely to incurable somatic diseases. This decision has sparked intense debate regarding equity in access to euthanasia and the right to self-determination for patients suffering from severe psychiatric conditions. From a legal perspective, the study investigates the inherent challenges in assessing the decision-making capacity of these patients. Additionally, it provides a brief comparative overview of the legislation in other European countries that have allowed euthanasia in the context of mental disorders. Finally, it analyzes the future landscape of euthanasia in Spain from a legal standpoint

Análisis jurídico del desperdicio alimentario: desafíos regulatorios y consideraciones bioéticas
(Edicions de la Universitat de Barcelona, 2026-02-16)
This paper examines food waste froma legal and bioethical perspective, emphasizing its social, environmental, and regulatory implications. Using a multidisciplinary approach, it argues that avoidably discarded food should not be seen as mere waste, but as a symptom of a production model that prioritizes profit over fundamental rights. The coexistence of surplus food with widespread food insecurity raises a deep ethical and legal paradox that demands structural responses. The analysis highlights the importance of principles such as distributive justice, intergenerational equity, and sustainable development in rethinking the legal framework around food waste. It contends that public policies must move beyond operational efficiency and take on an active role in resource redistribution. Within this context, Spain’s Law 1/2025 on food loss and waste prevention is critically reviewed. The study concludes that food waste regulation must be part of a broader food policy that treats food as a common good and addresses the structural inequalities that hinder access to it. Only through an integrated ethical and legal vision will it be possible to build a fairer, more sustainable food system that upholds human dignit
